Increase in Cost of Dog bite Claims due To Higher Dog Bite Lawsuit Verdicts

New information by the Insurance Information Institute suggests that there has been an increase in the cost of dog bite claims over the past year.The average dog bite claim cost insurers about 5% more in 2010 compared to 2009. Dog bites often result in extremely serious personal injuries. Our office has handled a significant number of dog bite cases in the last 20 years. The injuries from these matters appear to be becoming more and more severe. This may be as a result of more individuals owning dogs for protection or certain breeds that are more likely to attack persons. As an Atlanta injury lawyer, I strongly support the need for obedience training for dogs when they are puppies. I believe this would greatly reduce the number of overall attacks.

The analysis of homeowners’ insurance data by the Insurance Information Institute found that the average cost of dog bite claims in the United States in 2010 was $26,166.That’s an increase of 5.3% from $24,840 in 2009. The cost of dog bite claims increased a staggering 37% between 2003 and 2010.

There was a drop in the number of dog bite claims being filed.These dropped 4.9% from 16,586 claims in 2009 to 15,770 claims in 2010.

Feds Release New Bus Safety Rules to Prevent Accidents

A series of fatal and serious bus accidents recently have resulted in new proposals to enhance bus safety for American passengers, and prevent serious accidents.The Federal Motor Carrier Safety Administration, this week announced a new set of proposals to minimize the risk of bus crashes. As an Atlanta injury lawyer, I only hope that the proposed regulations are enacted. The regulations then need to be monitored over time and strengthened where necessary. Bus accidents are far more serious than car accidents, motorcycle accidents, pedestrian accidents and many truck accidents due to the number of persons who have the potential of suffering personal injuries.

There have been several bus accidents over the past two years that have indicated the need for new safety regulations that can help deal with some of the serious bus safety issues that we currently face. The new proposals aim to do that.For instance, one of the issues that have bothered Atlanta bus accident attorneys has been the fact that bus companies find it too easy to reappear under a new name and address after one of their vehicles has been involved in a fatal accident.The new rule would create a federal standard that would help determine whether a carrier used to exist under a different name earlier.This would close current loopholes that allow carriers to resurface a few months after a serious accident, under a new name.

The new proposals also make it tougher for commercial drivers to get their licenses.Under the proposals, a driver would need to have a commercial driver’s learner’s permit before he can receive his commercial driver’s license.Besides, the federal agency wants to establish a uniform CDL testing standard across the country.

Death in Cobb County, Georgia Car Accident Traced to Red Light Violations

The parents of a young Cobb County woman, who was killed in a car accident two weeks ago, are calling for stronger charges against the motorist involved.Cobb County police are blaming the accident on red light violations. Car accidents involving wrongful deaths often involve a red light violation. Of course, auto accidents of this type also result in significant personal injuries since persons trying to “beat” the red light are often traveling at a high rate of speed. As an Atlanta injury lawyer, I know these cases are occur far too often.

The young woman had been driving a Toyota Safari, which was struck by an Infiniti.The woman had a green light at an intersection, when the Infiniti driver ran a red light and broadsided the Toyota.The Toyota driver suffered serious injuries, and was rushed to the hospital.However, she died two days later.

The Infiniti driver now faces misdemeanor charges.However, the parents of the young woman want felony vehicular homicide charges to be brought against the man.Vehicular homicide charges can only brought in cases where the motorist was driving under the influence, was driving at excessive speeds or was on the run from police.This particular accident doesn’t seem to meet any of those criteria, and therefore, it isn’t very likely that felony charges will be filed here.

14% Decline in Georgia Motorcycle Accident Deaths in 2010

The Governors’ Highway Safety Association is predicting a 2% decline in motorcycle accident deaths for 2010, based on a slight decline in fatalities during the first nine months of the year.In Georgia, Atlanta motorcycle accident lawyers found slightly better news.The predicted decline in motorcycle accident fatalities in Georgia is a little more substantial than the national average.As an Atlanta injury lawyer, I welcome any decrease in the number of motorcycle accident deaths and hope this also indicates a reduction in the number of accidents involving serious personal injuries.

During the first nine months of 2009, there had been 112 motorcycle accident deaths in Georgia, and those numbers had decreased to 98 deaths during the same period in 2010.That was a decline of 14, and while it is not a bad performance, Georgia is way behind our neighbor Louisiana with a decline of 37, Oklahoma with a decline of 25 and Wisconsin with a decline of 24 fatalities. Georgia could do much better with saving motorcyclists lives every year, if it invested more in educating motorists about the specific dangers facing motorcyclists.

According to the report by the GHSA, motorcycle accident fatalities across the country decreased by approximately 2.4% during the first nine months of the year.The GHSA is predicting the total number of motorcycle accident fatalities for 2010 to be around 4, 376 or fewer.However, the agency is warning against any enthusiasm over this decline in motorcycle accident deaths.

Atlanta Children Escape Injuries After Ferocious Dog Bite attack

A young boy waiting at the bus stop in southwest Atlanta had a miraculous escape after a dog bite attack by a pair of Rottweilers.The boy, who was about eight or nine years old was standing at the bus stop waiting for his bus, when the two dogs turned up and the dog bite attack occurred.Another child was also waiting at the bus stop, but managed to escape.Fortunately for the boy, a neighbor was able to scare the dogs away. As an Atlanta injury attorney, I have often found that dog bite attacks often result in extremely serious personal injuries.

Both of the dogs belonged to separate dog owners.Both the dog owners have been cited by the Fulton County Animal Control and the dogs have been removed from the neighborhood.

Children are the biggest victims of dog bites in Atlanta.According to the Centers For Disease Control And Prevention, approximately 4.5 million Americans suffer dog bites every year.Of these, one in five bites result in injuries that are serious enough to require medical attention.Among child victims of dog bites, the rate of injuries is highest in children in the age group of 5 to 9.Besides, children are much more likely to require medical attention after a dog bite.

Workers Compensation Claim arises out of Serious Burns in Hall County Electrical Accident

A worker at a wastewater treatment plant in Hall County has suffered serious burn injuries in an electrical accident this week.This type of accident generally results in a complex workers compensation claim. The workers compensation insurance company often launches an immediate investigation to determine if there is any basis to deny the claim. The insurance company will then work hard to direct the person’s care to limit their financial exposure in the matter. As Atlanta workers compensation attorneys are well aware, it is important for workers injured in severe accidents to obtain counsel as soon as reasonably possible.

Also, this type of accident often results in a personal injury claim against a third party. For instance, the injuries may have resulted from a defective product or the negligence of a third party who previously worked on the device. Accordingly, a worker should make certain that the incident is thoroughly investigated for any potential third party personal injury claim.

The man, an electrician, was apparently the employee of a subcontractor, and was working at the County- owned Spout Springs Water Reclamation Facility when the electrical panel he was working on, exploded.The man suffered serious burn injuries, and was rushed to the Grady Memorial Hospital, one of the premier burn treatment facilities in the country.

No Injuries Reported in Atlanta area Nursing Home Roof Collapse

More than 100 residents of a nursing home in Gwinnett County, Georgia were moved to another facility last week, after the roof of their nursing home collapsed.Fortunately, the 109 residents did not suffer injuries during the collapse. As an Atlanta injury lawyer, I have seen a number of roof collapses that did not turn out nearly as well. When it comes to nursing homes, we are generally more focused on nursing home abuse issues.

According to news reports, the collapse occurred around 10 AM on Thursday at the Golden Living Center at 213 Scenic Highway in Lawrenceville.According to facility staff, workers were in the process of replacing the entire roof of the building when the collapse occurred.Apparently, the workers were engaged in removing and replacing roofing materials at the time of the collapse.The collapse occurred in the dining area of the facility.

Fortunately, none of the residents were in the dining area during the collapse.However, there could have been serious injuries if the collapse had occurred later in the day.Just a short while after the collapse, the residents were scheduled to spend some time in the dining area.The residents have now been shifted to other living facilities.

New Safety Initiatives to Prevent Motorcycle Accidents in Atlanta and throughout Georgia

The Georgia Department of Public Safety has begun implementing motorcycle safety checkpoints, as part of a program in an effort to prevent motorcycle accidents. Some of the most serious injuries and deaths often result from motorcycle accidents. Although motorcycles certainly need to be well maintained, these accidents are more often caused by drivers of cars who are not watching out for motorcycles. It would probably be more effective use of resources if the Department used their limited resources to commence a campaign to educate drivers to watch out for motorcycles and bicycles.

As part of the campaign that is being launched, the Georgia Department of Public Safety will conduct a total of six motorcycle checkpoints between 1 March 2011 and December 31, 2012.The first checkpoint of 2011 was held earlier this month along Interstate 75 and along Interstate 95.Motorcyclists traveling along any of the highways that have been marked for checkpoints will find signs that require them to exit at an inspection station.

The campaign is being funded by a $70,000 grant by the National Highway Traffic Safety Administration.Officers will be specifically looking to see if motorcycle drivers have licenses, and if they’re wearing helmets.They will also be checking to see that motorcycles are in good operating condition, and will specifically be looking out for bad tires, broken or malfunctioning headlights and tail lights.According to the Department of Public Safety, the checkpoints won’t be a major hindrance, and the average motorcyclist who is riding with a proper license, and is helmeted, will find that the delay lasts just about a minute.

Atlanta Boy Injured in SUV Car Accident

A six-year-old Atlanta boy who was injured in an SUV car accident in Cobb County is expected to recover from his injuries.The boy had been injured in the accident that occurred on Sunday at the intersection of Macland Road and John Ward Road.

The child was apparently traveling in an SUV that was T-boned by another vehicle at the intersection.The impact of the accident caused the SUV to flip over.The boy sustained a head injury, and had to be rushed to the hospital.Police are likely to charge the other driver with failure to yield.

Very often, Atlanta car accident attorneys notice that T-bone collisions which occur near an intersection, occur because one of the drivers ran a red light.T-bone accidents involve a car that crashes through traffic and into the side of another car.These side-impact accidents are some of the most injurious of all auto accidents.Side impact crashes can cause serious injuries and fatalities, because there is very little space protecting the occupants of the car from the full impact of the collision.This is unlike a frontal impact collision, where the front of the automobile absorbs much of the energy from the accident, cushioning the occupants from injuries.

Proposed Law Would Prevent Serious Georgia Bicycle Accidents

Motorists whizzing close by to bicyclists are responsible for approximately 1.2% of all bicycle accidents every year, but about 22% of those accidents result in catastrophic injuries or death.A new piece of legislation in Georgia would require that motorists passing by a bicyclist maintain a space of at least 3 feet between the vehicle and the bicycle.As an Atlanta injury lawyer, I strongly support the legislation. The legislation would help prevent accidents in Atlanta and throughout Georgia.

House Bill 180 requires motorists to pass at a safe distance from a bicycle.The term “safe distance” is defined as 3 feet.Across Georgia, bicyclists have been exposed to accident and injury risks from motorists “buzzing” past them.These risks would be avoided if the bill is passed.Although the risks that come when motorists pass too close to bicycles are common knowledge, few states have laws in place that prevent motorists from such behavior.In fact, only 16 states in the US have laws that establish a specific distance that motorists must maintain from a bicycle.Georgia, if it approves the law, would become one of the states that prioritize bicyclist safety.

This piece of legislation is one of several bicycle safety bills that are currently pending in the Georgia Assembly.Another bill, House Bill 101 defines bicycle lanes and establishes the installation of bicycle lanes to national guidelines.The bill would also require motorists to yield to bicyclists.Yet another bill, House Bill 71 would allow Georgia residents to petition their local administrations to allow them to bicycle on sidewalks.Under current laws, only children below the age of 12 can ride bicycles on sidewalks.Riding on the sidewalk may help prevent serious bicycle accidents.
