Enforcement of traffic laws, including those against drunk driving and speeding, need to be a major part of any auto accident prevention program by state and federal governments. These are the types of traffic law violations which lead to very serious car accidents resulting in catastrophic personal injuries and wrongful deaths.

The role that traffic enforcement can play in accident prevention tends to be a controversial topic.  However, a recent piece in The Atlantic calls for increasing traffic enforcement in order to help reduce the number of people involved in serious auto accidents.  The article refers to experiments in other states that have chosen to decrease traffic enforcement,  consequently leading to an increase in the number of car accidents and accident – related catastrophic personal injuries and wrongful deaths in these states.

Many car accident prevention programs these days focus heavily on the role of  road design in preventing car accidents.  However, there are many types of accidents that are not impacted or hindered by optimum road design.  For example, a large part of the spike in auto accident wrongful deaths in recent years is linked to the increase in the number of car accidents occurring at night.  Many of these auto accidents are speeding- related car accidents or drunk driving auto accidents that have very little to do with road design. These accidents are often connected to low levels of traffic enforcement.  Simply put,  if these speeding drivers and drunk motorists are fined for violations and taken off the streets, we are more likely to see a decline in car accident numbers.

There are a significant number of persons in the United States who like to drive what are commonly called “muscle cars.” These are cars with high horsepower which are capable of high speeds and fast acceleration.  Examples of cars often referred to as “muscle cars” include the Dodge Charger, Ford Mustang, Chevrolet Monte Carlo SS, Dodge Challenger and the Camaro. Unfortunately, some muscle cars have been identified with an increase in car accident wrongful deaths.

A new study by the Insurance Institute  for Highway Safety finds that smaller cars  that have more powerful engines can be deadly for not just motorists and passengers, but also for drivers of other cars.  Traditionally,  safety experts have believed that larger vehicles like SUVs and pickup trucks are more dangerous  for drivers and passengers of other vehicles in  the event of an accident.  However,  the dangers may be even more serious in the case of smaller muscle cars like the Ford Mustang or other similar vehicles.

Muscle  cars are basically smaller American cars that have increased horsepower. These are boxy cars that  usually have 2 doors and a powerful engine.  These  cars are typically marketed to a certain type of consumer,  and the study believes that the way in which these cars are marketed also contributes to the higher death rates associated with these vehicles.

Statistics  seem to show a slight drop in the number of people killed in car accidents across the country during the first 9 months of 2022, compared to the same period of time the previous year.   However, the number of people  killed in pedestrian accidents and bicycle accidents increased over the same period of time.

New statistics released by the National Highway Traffic Safety Administration show a very  slight drop in auto accident fatalities in the first 9 months of last year, compared to the same period of time in 2019. A  total of 31,785 people were killed in car accidents between January and September 2022, compared to the previous year.  That was a 0.2%  drop.  The  bad news, however, is that bicycle accident and pedestrian  accident wrongful deaths continued to rise over the first 9 months of 2022 as they have  for several years now.

Car  accident deaths across the country and in Georgia have been at elevated levels since 2020 when the pandemic struck and lock downs were imposed.  In  spite of a drop in traffic volumes with few people driving on the streets, the number of auto accidents began to spike, confounding experts.  Since  then, we have learned that auto accident numbers began to rise in 2020 because of reckless driving behaviors, including speeding.  With  lower traffic volumes on the road, motorists became  much more comfortable driving at high speeds, and those behaviors  have continued since then.  Additionally, the lack of enforcement campaigns during this time also meant  more numbers of people driving without wearing their seatbelts or driving under the influence of alcohol, contributing to those high statistics.

Even as federal transportation authorities grapple with a spike in deaths in all types of car accidents, a new study finds that high visibility traffic enforcement campaigns may possibly hold the key to reducing those numbers and keeping motorists safe.

The National Highway Traffic Safety Administration recently revealed that auto accident death numbers are on the rise.  Those numbers were extremely high in 2020, a year in which American motorists drove fewer vehicle miles than in previous years.  In 2021, according to projected estimates, those numbers were at their highest in more than a decade.   This increase has been high enough to spur federal transportation authorities into action. The new National Highway Traffic Safety Administration chief has announced his Roadway Safety Strategy, a plan that aims to combine efforts towards safer roads, vehicles and motorists to reduce car accident death numbers.

Many American cities, including our very own Atlanta have adopted the Vision Zero goal of reducing traffic accidents to the minimum over the next few decades. However, while the goal is laudable, the reality is that most American cities have struggled in their efforts in meeting this goal.

The Vision Zero goal is a commendable one, and has become very popular with cities around the world. Atlanta has its own version of the Vision Zero goal. According to the Atlanta Department of Transportation, the Vision Zero goal is a systems-driven approach to  reducing traffic accident fatalities through measures like speed management and better street design.  There is no denying that there can be no progress made in reducing traffic accident facilities to the absolute minimum unless we take into consideration the safety of pedestrians and bicyclists.

In most European countries that have adopted Vision Zero, the program has been successful.  According to this Blomberg report, Oslo, the capital city of Norway is a prime example of what can happen when transportation agencies and the population come together with a single goal in mind – to minimize fatal accidents that are entirely preventable.  Fatal accidents in Oslo are so rare that they result in a full-blown investigation and not just a police report when they occur.

A police officer was killed, and another person suffered personal injury in a car accident that police are now blaming on a wrong way driver.The crash occurred on westbound interstate-20 early in the morning.

According to DeKalb police, the driver of a westbound vehicle crashed into a sports utility vehicle that was traveling eastbound in the westbound lanes.The driver of the westbound car sustained fatal injuries in the crash.The wrong way driver also suffered injuries in the auto accident.

Investigations into the car accident have begun, and investigators now believe that the driver of the sport-utility vehicle was traveling in the wrong direction.These investigations are likely to also include blood-alcohol tests to determine if the driver was driving under the influence of alcohol.

A woman was killed and her five-year-old son suffered a personal injury in a car accident in Henry County last week.The accident occurred on Georgia Highway 20 near McDonough.According to police, a Chrysler station wagon crossed the centerline, and crashed into a Chevrolet Silverado being driven by the victim.The woman sustained massive injuries, and was rushed to the hospital, but succumbed to injuries later.Her five-year-old child was in the backseat, and also suffered injuries in the auto accident. Given how the accident unfolded, a wrongful death and personal injury claim appear likely.

The driver of the station wagon suffered injuries, and was taken to the Atlanta Medical Center.Police are still trying to determine whether to press charges against her. Georgia’s laws allow survivors of victims of a car accident to file a claim for wrongful deathdamages.Under Georgia’s laws, only certain individuals can file a wrongful death claim for monetary damages.For instance, in the case of an adult victim, his spouse and children have the right to pursue a wrongful death claim, but the spouse controls the any lawsuit.However, when the deceased is a child, the parents have the right to file a claim.When a person dies in a car accident and does not leave behind parents, spouse or children, then his estate has the right to file a wrongful death claim against the motorist responsible for the accident.

In addition to a wrongful death claim, the heirs may also pursue a separate “estate claim.” A wrongful death claim allows a person to recover for the full value of someone’s life, while an estate claim permits the estate to recover for economic losses such as medical expenses and funeral bills as well as for pain and suffering.In some cases, an “estate claim” may also include a claim for punitive damages.Punitive damages are awarded in rare circumstances where the defendant has been found to have acted intentionally, willfully or with a conscious disregard for the consequences of their conduct. Most punitive damage claims fall in this last category.

The parents of a young Cobb County woman, who was killed in a car accident two weeks ago, are calling for stronger charges against the motorist involved.Cobb County police are blaming the accident on red light violations. Car accidents involving wrongful deaths often involve a red light violation. Of course, auto accidents of this type also result in significant personal injuries since persons trying to “beat” the red light are often traveling at a high rate of speed. As an Atlanta injury lawyer, I know these cases are occur far too often.

The young woman had been driving a Toyota Safari, which was struck by an Infiniti.The woman had a green light at an intersection, when the Infiniti driver ran a red light and broadsided the Toyota.The Toyota driver suffered serious injuries, and was rushed to the hospital.However, she died two days later.

The Infiniti driver now faces misdemeanor charges.However, the parents of the young woman want felony vehicular homicide charges to be brought against the man.Vehicular homicide charges can only brought in cases where the motorist was driving under the influence, was driving at excessive speeds or was on the run from police.This particular accident doesn’t seem to meet any of those criteria, and therefore, it isn’t very likely that felony charges will be filed here.

Every year, approximately 300 people are killed in accidents caused by wrong way motorists.Many of these accidents are caused because motorists are driving under the influence of alcohol, and end up traveling in the opposite direction.Alcohol use is the most common cause of wrong way driving.It’s not so surprising to Atlanta car accident attorneys that alcohol use is so often cited in wrong way driving.Alcohol use clouds a person’s judgment, blurs his vision and affects his powers of reasoning.A person like this is also likely to miss highway street signs, ending with him driving in the opposite direction.

Motorist in Deadly Georgia Easter Accident Sentenced to 36 Years in Prison

The BMW driver, who was involved in a deadly car accident that killed a total of five people last Easter in Fulton County, has been sentenced to six years in prison.Aimee Michaels also received 14 years of probation, and has been ordered to surrender her driver’s license, and not to operate a motor vehicle.Her mother was sentenced to eight years for tampering with evidence and hindering her daughter’s arrest.

The accident occurred on April 12 last year.Michaels apparently lost control of the BMW she was driving, and struck a Mercedes.The impact of the accident sent the Mercedes crashing into a Volkswagen.The Mercedes burst into flames.All four occupants, including a couple, a nine-year-old girl and an infant boy were killed instantly in the crash.In the Volkswagen were a woman and her nine-year-old daughter.The daughter was killed in the crash.It was one of the deadliest crashes that Atlanta car accident lawyers had seen in recent times.
