Feds Release New Bus Safety Rules to Prevent Accidents

A series of fatal and serious bus accidents recently have resulted in new proposals to enhance bus safety for American passengers, and prevent serious accidents.The Federal Motor Carrier Safety Administration, this week announced a new set of proposals to minimize the risk of bus crashes. As an Atlanta injury lawyer, I only hope that the proposed regulations are enacted. The regulations then need to be monitored over time and strengthened where necessary. Bus accidents are far more serious than car accidents, motorcycle accidents, pedestrian accidents and many truck accidents due to the number of persons who have the potential of suffering personal injuries.

There have been several bus accidents over the past two years that have indicated the need for new safety regulations that can help deal with some of the serious bus safety issues that we currently face. The new proposals aim to do that.For instance, one of the issues that have bothered Atlanta bus accident attorneys has been the fact that bus companies find it too easy to reappear under a new name and address after one of their vehicles has been involved in a fatal accident.The new rule would create a federal standard that would help determine whether a carrier used to exist under a different name earlier.This would close current loopholes that allow carriers to resurface a few months after a serious accident, under a new name.

The new proposals also make it tougher for commercial drivers to get their licenses.Under the proposals, a driver would need to have a commercial driver’s learner’s permit before he can receive his commercial driver’s license.Besides, the federal agency wants to establish a uniform CDL testing standard across the country.

Focus on Preventing Distracted Driving Car Accidents in Georgia This April

As Atlanta injury attorney I often notice people using cell phones while driving almost every day as we drive to work.Such behaviors significantly increase their risk of an auto accident, including those that result in serious personal injury.Unfortunately, this isn’t just a fad that affects the young and teen drivers, but a dangerous phenomenon that also touches most motorists.This April, the focus will be on minimizing the number of accidents every year in Georgia caused due to distracted driving, as national and local transportation safety agencies mark National Distracted Driving Month. Reducing distracted driving is probably one of the best ways to decrease the overall number of car accidents in Atlanta and throughout Georgia.

April was set as National Distracted Driving Month through a special move by Congress, and across the country including Georgia, state and local transportation agencies will mark the month with special efforts to crack down on distracted drivers, and raise awareness about these practices.While much of the focus on distracted drivers this month is likely to be on those using cell phones while driving, there are all kinds of other distractions that increase the risk of an accident.In fact, some studies estimate that approximately 80% of all accidents are caused by some kind of distractions.These include motorists using cell phones, texting, changing radio stations, snacking, reading newspapers, applying makeup, and performing any other activities that take their eyes away from the road and their hands off the steering wheel.

However, the risk from the use of cell phones and other electronic communication devices while driving is especially greater, because cell phones can be found in almost every car.Besides, in a tough economy, American workers have felt under greater pressure than ever to constantly stay in touch with the office 24/7, even while they’re driving. There is also an entire section of Atlanta’s population that has been raised on Facebook and MySpace. For these drivers, not being in touch with their friends 24/7 via smart phone is, quite simply, unthinkable.

IIHS Study Analyzes Use of Technology to Prevent Atlanta Pedestrian Accidents

The Insurance Institute for Highway Safety has come out with a new study that promotes traffic safety initiatives of the kind Atlanta pedestrian accident attorneys have been advocating for too -the use of technology to prevent pedestrian accidents. As an Atlanta injury lawyer, I have seen a significant number of car accidents involving pedestrians. These auto accidents often involve serious personal injuries and many times result in the wrongful death of the pedestrian. Any technology that decreases the number of pedestrian accidents is a welcome innovation.

The Insurance Institute has studied technologies that can help prevent these accidents, and for this, it has analyzed the most common kinds of pedestrian accident scenarios.Between 2005 and 2009, 224,000 pedestrians were involved in front-impact accidents involving single passenger vehicles.Out of these 13,193 pedestrians were killed.

According to the Insurance Institute, the most common kinds of pedestrian accident scenarios involve a person crossing the road, and a car traveling straight ahead towards the pedestrian.In these cases, the motorist has a clear view of the pedestrian, but is unable to stop in time.The Insurance Institute study is promoting the use of forward collision warning systems, including pedestrian technology, to prevent these accidents.Forward collision warning systems have been very popular for some time now.These systems allow the driver to detect an object that is in the path of the car, thereby encouraging him to apply the brakes, and prevent an accident.Some of these systems now come with pedestrian detection technology that enables the driver to detect not only an object, but also a pedestrian in the car’s path.

NTSB Calls for Use of Technology to Prevent Bus Accidents

Since the Bluffton University bus accident in Atlanta in 2007, Atlanta bus accident attorneys have been calling for greater use of technology to prevent bus accidents and reduce the severity of injuries.It certainly looks like we have been on the right track all along.The National Transportation Safety Board this week said that although technology that could prevent bus accidents exists, federal regulators have failed to act to implement their use. As an Atlanta injury lawyer, I applaud the NTSB’s criticism of federal regulators.

The National Transportation Safety Board comments came as Atlanta bus accident lawyers and bus safety advocates from around the country have been increasing calls for stronger bus safety regulations by the federal legislation.Those calls came in the aftermath of a deadly bus accident in New York in March that resulted in the wrongful death of 15 people.The bus, a low-budget carrier transferring passengers to a casino in Connecticut, was on its way back to Chinatown, when it skidded, flipped over, and crashed into a sign pole.The impact sliced the bus into two, killing 14 passengers almost immediately, while the last passenger died in the hospital a few days later.

This week, the National Transportation Safety Board Chairman Deborah Hersmann had stinging criticism for the bus industry, which that has lagged behind in providing safety to its passengers.Deriding the state of American bus safety, Hersmann said that her minivan came with more advanced safety features than most buses on American roads.

New Safety Initiatives to Prevent Motorcycle Accidents in Atlanta and throughout Georgia

The Georgia Department of Public Safety has begun implementing motorcycle safety checkpoints, as part of a program in an effort to prevent motorcycle accidents. Some of the most serious injuries and deaths often result from motorcycle accidents. Although motorcycles certainly need to be well maintained, these accidents are more often caused by drivers of cars who are not watching out for motorcycles. It would probably be more effective use of resources if the Department used their limited resources to commence a campaign to educate drivers to watch out for motorcycles and bicycles.

As part of the campaign that is being launched, the Georgia Department of Public Safety will conduct a total of six motorcycle checkpoints between 1 March 2011 and December 31, 2012.The first checkpoint of 2011 was held earlier this month along Interstate 75 and along Interstate 95.Motorcyclists traveling along any of the highways that have been marked for checkpoints will find signs that require them to exit at an inspection station.

The campaign is being funded by a $70,000 grant by the National Highway Traffic Safety Administration.Officers will be specifically looking to see if motorcycle drivers have licenses, and if they’re wearing helmets.They will also be checking to see that motorcycles are in good operating condition, and will specifically be looking out for bad tires, broken or malfunctioning headlights and tail lights.According to the Department of Public Safety, the checkpoints won’t be a major hindrance, and the average motorcyclist who is riding with a proper license, and is helmeted, will find that the delay lasts just about a minute.

US DOT, Consumer Reports Announce Campaign to Prevent Teen Auto Accidents

According to Consumer Reports, teenagers are dying and suffering serious injuries every year because of car accidents caused by texting and using cell phones while driving.The safety advocacy group along with the US Department of Transportation have announced a new campaign aimed at minimizing the incidence of distracted driving among teen motorists. As an Atlanta injury lawyer, I very much applaud their efforts. Car accidents are one of the leading causes of deaths and injury among teenagers. Simply put, too many families have been devastated by these car accidents.

According to a study conducted by researchers at the University of Utah, the average reaction time for a teenage motorist driving and talking on a cell phone was equal to that of a 70-year-old driver not using a phone while driving.There are numerous other studies that have clearly laid out the significantly increased accident risks that come when motorists are using cell phones while driving.For instance, a study by the Virginia Tech Transportation Institute found that texting while driving could increase a motorist’s risk of an accident by a staggering 23 times.

According to the same study, physically dialing a phone while driving increases the risk of an accident by as much as six times.In 2009, approximately 16% of all fatal accidents were caused by distracted driving.At least one in five of those deaths involved the use of cell phones or texting while driving.

Ignition Interlock Systems Can Reduce DUI Car Accidents

As an Atlanta injury lawyer, I often find that a significant number of wrongful deaths and serious personal injuries arise from drunk driving accidents involving repeat offenders.A new study by the Centers for Disease Control and Prevention indicates that the use of ignition interlock devices is successful in preventing repeat drunk driving. Such prevention would unquestionably result in a reduction in drunk driving accidents, injuries and deaths. Each and every Atlanta injury lawyer should advocate for the use of these devices.

The study found that recidivism rates for DUI dropped by approximately 67% when ignition interlock devices were used.Many states including Georgia, have adopted alcohol ignition interlock devices as part of their efforts against DUI.In Georgia, persons convicted of DUI can be ordered by courts to have an ignition interlock device installed in their vehicles if they have prior DUI convictions too.The device requires drivers to blow into it, and measures the alcohol on his breath.If the alcohol content is found to be excessive, the device prevents the motorist from starting the engine.The researchers say that these devices are so useful in preventing drunk driving accidents, that they should be made a mandatory part of DUI prevention efforts around the country. As an injury lawyer, I couldn’t agree more.

Ignition interlock devices receive a lot of criticism from DUI attorneys and the beverage industry.However, these devices have become more sophisticated, accurate and reliable over the years.It’s much harder to “fool” an ignition interlock system now than it used to be a couple of years ago.Some devices require the user to hum while breathing into the tube.

DOT Proposal to Prevent Distracted Driving Truck Accidents

As Atlanta truck accident attorneyswho have been concerned about the lack of serious restrictions on cell phone use by truck drivers, we were happy with a new Department of Transportation proposal banning the use of handheld cell phones by truck and bus drivers. The banning of cell phones by truck drivers and bus drivers will greatly decrease the likelihood of truck accidents and bus accidents. Personal injury attorneys and lawyers for the trucking and busing companies will closely monitor the new proposal. Simply put, the ban would prevent a significant number of personal injuries and deaths each year.

This week, the DOT made a formal announcement, proposing the ban. The ban would include not just talking on a cell phone, but also holding and dialing a cell phone while driving.The announcement comes just months after a ban on text messaging while driving for both commercial truck and bus drivers earlier this year.

According to the DOT, inattention was a factor in 9% of all commercial truck accidents in 2009. Meanwhile last year, between 6% and 13% of all bus accidents were linked to distracted driving. Obviously, there is a need for a law that would completely ban the use of handheld cell phones and text messaging devices for all commercial truck and bus drivers.

New System Could Prevent Drowsy Driving-Related Auto Accidents

There is no doubt that drowsy driving causes a significant number of auto accidents and, therefore, is a serious problem on Atlanta streets. However, it has been ignored as an accident factor not just by legislators, but also by law enforcement officers who investigate auto accidents. According to a recent study by the National Sleep Foundation, as many as one in six serious or fatal car accidents is linked to drowsy driving.

Those statistics released by the National Sleep Foundation earlier this year made everyone sit up and take notice. However, as Atlanta car accident attorneys, we have been awake to the dangers of drowsy driving for years now.That’s why it was encouraging to read about new technology to prevent drowsy driving.

A new device manufactured by a Danish company acts as an automated drowsy driving test system inside your car to let you know when it’s time for you to take a break. The device is called Anti-Sleep Pilot, and it’s manufactured by Denmark-based APS Technology. The device develops a profile of the driver based on a number of questions, including whether the driver is on any medications, or whether he’s a shift-based worker. This profile is stored in the system, and when the driver is operating the vehicle, the system analyzes this data along with other information to develop a test.

Auto Accident Injuries Decrease with Stronger Auto Roofs

A new study confirms that stronger automobile roofs minimize the severity of injuries in a rollover auto accidents. The study conducted by the National Highway Traffic Safety Administration compared automobile roof strength test results of several cars with real- life rollover auto accidents. The researchers found a direct link between automobile roof strength results and the number of centimeters that the roof is pushed into the occupant at the time of an auto accident. Earlier studies had also confirmed that stronger auto roofs lower the risk of, as well as severity of, injuries to the head, neck and face.

The NHTSA study comes at an opportune time. Last year, the agency had announced that it was strengthening auto roof strength standards. According to the agency’s new standards, automakers will need to maintain a ratio of 1.5 for vehicles with gross weight ratings from 6,000 to 10,000 pounds. The current ratings only require a ratio of 1.5 for vehicles with gross weight ratings of up to 6,000 pounds. According to the agency, the new rules will lead to approximately 135 lives being saved every year in rollover auto accidents.

Rollovers comprise a small percentage of the total number of car accidents in the US every year. However, these are some of the most devastating auto accidents that Atlanta car accident attorneys come across, and in fact, cause approximately 30% of all traffic fatalities. The NHTSA has focused heavily on reducing the numbers of wrongful deaths in these auto accidents. For instance, new rules require all automobiles to come with electronic stability control systems that reduce the risk of a rollover. You can now find electronic stability control systems on most models that are available in the market. These systems prevent the risk of a rollover by allowing the driver to retain control over his vehicle during certain high-risk maneuvers, like braking or turning at high speeds.
